"Assumed Risk" legal information for Mt. Bikers

I am trying to get some information to the Rock Hill city personnel in regards to what the assumed risk is to mt. bikers vs. what a land owner is responsible for.  I thought that I remembered a thread here about this recently.  Is there an "inherent risk" when you mt. bike that absolves the land owner for some responsibility in the event of an accident NOT caused by faulty man made features, etc.?

Any websites that I could pass along would be great appreciated.

Thanks,

Justin

Read that article. I think it is different from state to state. But I could be wrong I usually am.

Look at Title 51 & 52.
Title 51 - Parks, Recreation and Tourism
Title 52 - Amusements and Athletic Contests

Government has no reason to use common sense or be efficient as it pays no price for failure.

Google the SC Recreational Use Statute. This gebnerally applies only to private landowners, but the following article states that SC Courts have applied its protections to municipalities andother public entities as well. Look for - The South Carolina Recreational Use Statute: an Analysis, Comparison and Critique Environmental Advocacy Seminar By: Doug Webb April 25, 2005.

There are also sovereign immunity and other statutes that protect most municipalities. They can get more complex. Your guy probably needs to talk with his City Attorney and or Risk manager
