Hello everyone, I came across this article and am amazed that a bicycle company would take such steps towards a small business.  I now would never consider purchasing any of their products.

I've read conflicting reports, and it might come down to a requirement in US/Canadian trademark law where if you don't make attempts like this you can lose your trademark.  But the Big S also went after former employees last year for opening their own frame company, so who knows!

That being said, a shop back home opened up three years ago called "Spark" and Scott went after them for trademark infringement and whatnot.  They were able to work it out without a lawsuit and no big deal was made.  I talked to that owner this weekend and he thinks this is a case of a shop owner trying to get publicity.

FWIW Specialized had to change the name on thier Carve Frame, to Crave for this very reason. I guess they are spreading the Christmas Cheer.

In other news, Sheepialized doesn't even own the trademark.

in semi-related news, besides the lawsuit did anybody check out the built wheels on the CafeRoubaix website? They have some pretty light chinese clinchers and tubulars for cheap.

While I completely agree that this move is a low one, their legal actions have nothing to do with their product. And while you might think, "I am not going to give money to a company like that", there are dozens, and I mean dozens of super cool dudes that work for Specialized who I am sure are every bit as angry as you and the rest of the cycling world.

I'm sure that they're other companies that build just as good, if not better products that would not sue someone over naming rights of a product even though (I don't believe) Specialized does not own the rights to the name Robaix.  That's great that they have "super cool dudes" working for them that are angry.  Does not change the fact that Specialized is bringing suit against small business owner that probably does it more for the love, while making a living at it.

Matt, thats the link i was going to post too. ASI never applied for the trademark in Canada, they didnt even know that Specialized had applied or recieved the trademark in Canada. If the article is true then they have first first use rights to the TM, so Specialized was out of line.

IMO, whether or not they knew the legality in full terms, they should still have a better argument than "people might confuse their wheels with our bikes." Especially since they have a long track record of legally jumping on others who never really presented a threat to them either.

No question Specialized did the equivalent of starting a bar fight and getting it's butt kicked publicly.  There are better ways of protecting brand identity without being a douche about it.  Best thing Specialized could do right now is publicly fire it's legal team (be it in house or contracted) & apologize.  Regardless of how they move forward, they will be walking around with a couple of black eyes for awhile.
