Waivers are only good for the risks stated in them and do not cover negligence. It won't do much for the WWC in this case.

the indemnity clause of the waiver includes claims of negligence.

Here's a nice quote from a WCNC article:

Two former Whitewater Center employees told NBC Charlotte that none of this surprises them. One of them said the water was dirty, and in fact, some workers got sick because of it. "We called it river rot," the unidentified former employee said, "It's where your foot gets wet and if you have cuts, they never heal and eventually gets infected from whatever."

As mtbchk mentioned, and now I've heard from a couple other sources, the filtration system required frequent maintenance and wasn't running all the time. USNWC leaders aren't talking to media. What they need is transparency and openness, not going into turtle mode.

I think this is the type of thing is their biggest worry.  If they can show negligence (i.e. they didn't run the filtration system continually or as much as they should), that could mean they are outside the bounds of an insurance policy, requiring them to carry the finanncial burden.  Just speculating, of course, but that could spell major trouble.

However, at the same time, I'm with the previous poster that said "I'm surprised this doesn't happen in the other bodies of water..."  Lake Norman, for example, seems like a petri dish.  In the summer, the water is literally hot in some spots, and ridiculously dirty.  Just looking at it, it appears disgusting.

Anyway, I hope it all works out.  I would hate to see WWC go out of business.  It's one of the best attractions in Charlotte.

A good theory is the reason it's not happening in other bodies of water to this degree is the water treatment that is performed at WWC.

It kills or filters out the natural predators of this amoeba (small fish, flies, worms, etc..), but the treatment process isn't significant enough to kill or filter out the amoeba's themselves. This allows the amoebas to proliferate in the water unchecked.

These amoebas are 8-15 microns in size. So they are very small. Much smaller than the predators that feed upon them.

I think the solution is in the water source. If the water source does not contain these amoebas or they are removed by adequate filtration, then the problem can not exist. In some cases they have been shown to be resistant to chlorine.

My opinion is that this is all a bunch of political hogwash and it will blow over. Calm down folks. If Lee posts up that the trails are closing, then I'll ponder the impact. Smiley

No offense to WWC employees in general, but the majority of those folks in the water or raft guide/river guides are young folks who don't know squat.  If anything those guys plus the thousands of kayaker's are a good thing for USNWC because none of them have ever died from an amoeba.  The Catawba river is dirty as hell and tons of prople are in there all summer.  The USNWC has insurance. This will pass. It will sting financially but it will pass.  I believe this case will go the route of a civil trial and it will be hard to prove that USNWC is the place where the meningitis originated from but that will be up to a jury unless they settle. It will be hard to overcome the waiver from the perspective of negligence or pseudo wrongful death, etc. IMO....sincere thoughts on the loss of beautiful person.  I hope all parties can move forward.

Haha the news blows so hard. It's hilarious watching the people that are known druggies and problem staff, whom were fired for being &^&^heads being quoted about this. They know jack &^&^ about water cleanliness. It bums me out to see the outdoor community participating in this plebian witch hunt to the degree that they have.

I agree.  Makes me angry that the news would report statements like this with no substantial evidence that it is true.  Anything to sell papers or get someone to watch tv.

With the channel drying out over the next few days, it might be a good time for 'Rumble in the Concrete Jungle" in July.

It was probably our dirty mountain bike tires that introduced the amoeba in the 1st place...it's always the mountain bikers fault Wink

River Jam tonight should be interesting.  Will the lack of a river dampen the spirits of those that come out for the music and land-based activities.?

I hate that all this is happening at USNWC.  Everyone who works over there just got their world flipped in an instant.

More incentive to get the trails open sooner now that rafting isn't drawing a crowd?

The land based activities were very slow during the day - some help were let go early. The place was dead about 1/2 hour before the musiic started.  They ended up with a decent crowd, though not nearly as many folk as I've seen at previous Riverjams.

If the trails were open there would have been a few more perhaps.

I was able to show up and get a table with no wait.  There were some folks out there...

When I go there and when I left the news crews were hanging out at the entrance and out by the East Main entrance.  They are such vultures.

On a side note:
I wish they would bring the bluegrass music back for most if not all of the river jams.  That music just fits the vibe.  Last nights band was too "county fair" for me.
